My feeling of why it's going down is, it's no longer run by people that are capable of building AI. Look at the leadership faces of openai. Who among them has any substance to build a AI? One is a business dude(good one) and another a product manager. Where are the techies?

Not really? He barely had a case. If you look at this strengths in the case, the judge has to rule that whatever openAI has achieved till now it's AGI or not. Only if it's AGI, then Musk will have his lawsuit see a winning chance.
