HELP!! My company is not letting me leave!

Hey folks, I'm currently working for a US client and I am 100% billable to them if that information matters. According to the offer letter, the notice period is of 90 days but there's a buyback option where one can choose to pay and not serve the notice period. But from what I've heard, it's up to Capgemini to accept that buyback offer or not. So I've recently received an offer from a Singapore based startup and I told them that I can join in 30 days cuz if I hadn't, they wouldn't have even interviewed me in the first place. They're okay with buying back my 1 month and let me serve 30 days but I'm concerned what if Capgemini refuses to let me leave. What are my options here? Can I tell them that I'm leaving company due to some personal/health issues so I can get an early release. Do I need to involve a lawyer? Thoughts please. Thanks.

Going through something similar where the management has laid off 1/3rd the total team via forced resignation and without any severance. A bunch of folks who stood up to ask for reasons, severance etc are being threatened with termination and bad experience letter (and even lawsuits) Could really use your take if you or your colleagues have gone through something similar.

Hi. I received a termination letter from my past company. The reason was, I sent my resignation letter from home and responded only when they reached out. I know I am at fault. Should have sent resignation from office itself. But their punishment seems very harsh. I didn't get a chance to explain myself. Wherever I am applying for jobs, getting turned down as I do not have experience letter and relieving letter. Having a termination letter seems to be equal to having a criminal record. I tried requesting my ex company, but seems they have forgotten my existence, and talked in a rude manner. Day by day I am losing confidence. Trying my hand at freelancing also, but it would be like starting from zero. How can I repair my situation. Advice pls. PS: Humble request to all, no trolling please. Already I am down, don't want to get out.

Previously I worked in Persistent Systems for 2 years. Recently my hr called me to share the screen and resign. They have given me 7 days time to submit laptop and all the assets, leave the company. I just want to understand can't we do anything if they asked to do force resign. Because I have been in this company for 2 years, past 6 months they started doing this for atleast 40 employees per month only from my branch Hyderabad . Now it has become per week because they don't have projects and lot of projects are going to end in few months and already few projects moved out because when I spoked with senior in the company they are saying projects signed for 5 year's contract has now not interested to move. I asked why because of internal company politics, favouritism, fake and backdoor employees, over commitment due to these projects are not delivered in given deadline. How employees Will look for another oppurtunity in 7 days, also in my case when said to my recruiter that I am laid off they didn't schedule interview call then I changed my plan started saying them that I am having offer of A from x company going to join in next 15 days, then they shared scheduling interview. Won't there be any legal action we can take on employer as an employee in this cases.

It didn't bode well with the founder when I refused, and he terminated my employment with immediate effect. I haven't received a salary for the last month I worked there. The founder and the team are not responding to any of my calls, emails, and text messages. Any advice on how to navigate this? Contemplating the legal route now.

Sorry for the long post :( I'm a 2021 graduate from a tier 3 college. I was working at a small startup based in Bengaluru that is into SAAS. The headcount is less than 20 and a completely remote job. I don't have any notice period. I was told that I can leave the company whenever I want without any prior notice. And it's not mentioned anywhere in the contract. I had a promotion due in September 2022 in which the new agreement was supposed to be implemented where I had to serve a 90 day notice period and salary hike of 15% of my current CTC. But the promotion was put on hold till now. I asked them multiple times but I was told that it's on hold indefinitely due to "shortage of funds". On December 31st I sent a resignation letter as it will be my last working day. Even though it was a very short notice, I completed all the documentation about the things I worked on. Anyone who can understand English can deploy the entire product. And moreover everyone had worked on the product and almost everyone had a good understanding of the product. Sometime in 2021, I received a bonus of 62k which was sent to my personal bank account (the company itself didn't have a corporate account back then). Since the company didn't provide me any work laptop, I was told casually that I can use the bonus to purchase a new laptop or keep it to myself. I made a mistake of now waiting to get the December month salary before resigning. Now he's telling me that the bonus he sent is for the company laptop and it will be adjusted as my December month salary. When I asked about the purpose of the bonus was not to get the company laptop but to keep it myself, he's refusing to accept it. (Almost everyone in the company uses their personal laptop). And coincidentally there was a service outage as the company uses free services wherever available (for example, oracle cloud free tier, free version of slack, GitHub and lot more). Standard stupid Indian HRs. Asking to share screen and resign. If you don't resign threatening to withhold the experience letter etc. Yaay to our labour laws!!

I'm currently working on an FTE job - wherein the offer letter its mentioned "During the term of your employment with the Company, you may not engage in any employment or act in any way, which either conflicts with your duties and obligations to the Company, or is contrary to the policies or the interests of the Company." Now, I'm getting enough time and I want to consider working in a 0-1 startup, and the new company I'm joining will know about my current employer - The above mentioned is the only clause the current employer have regarding working in other company. Can the current employer legally put a case anytime in the future if they get to know this? - what are the loopholes I can use here? What position I can join in as (Consultant, Advisory role) - Still an early career professional in order to avoid conflict afterwards. Thank you for your help!!
