One year might be an overkill. However 7-8 months is the sweet spot. The infant would've started eating solid food without having to rely on mother's feed. Also the food intake duration, peepoo duration would be a few hours apart. Easier for someone else (a family member or a daycare) to take care of the infant.

Am I the asshole?

After a few months clear to me an employee was taking company for a ride. Average a few days a week in the office, otherwise sick/on errands, delivered no work. CTC 55L.

Before I could fire her, she announced she was taking Maternity leave a few months into the job. Well crap guess I need to pay her for 6 more months more because of laws I don't understand. Rip my bank account.

She returns, same issues. I put her on a pip & she resigned telling me I'm sexist and it will be hard to find a new job now. I say sorry, performance was bad, she can do pip and stay if things are better. She askes for 2 months salary and i agree.

A lawyer calls telling me I need to pay more or they will file a case. Said I discriminated to her, and it's not legal.

I think this person is a bully/psycho/self entitled. But am I the asshole?

This will be actually a disadvantage to all women out there, company will prefer less those who are newly married or planning to have a kid.

I don't think anyone wants 2 years leave but provide support like WFH, flexible schedule, child care, etc.

For anyone interested in how things turned out, here it is...

TLDR: Employee/new mom filed an FIR, police closed it after she admitted she quit after we tried to put her on a PIP. (In FIR she said she was wrongly terminated)

The women's commission of India summoned me after and it was an experience! I got scolded for about 2h by four women... but in the end they just scolded me like angry teachers? I guess they tried to give the lady some satisfaction by humiliating me. Pretty sad if that's all they can do to represent women with genuine cases.

Overall the average grapevine user said I was in the wrong for putting a new mom on a PIP, regardless of performance before and after pregnancy.

Most critical folks told me I should've informed the employee about performance issues before maternity. Lawyers say I made the right choice and protected the company.

It's a bit messed up that laws designed to protect women at work end up making things worse for them. Because of legal fear we went directly to a formal PIP with recorded calls with HR, the direct manager and others refused to do anything without legal advice. But in the end, she filed a case, so perhaps the cold approach recommended by lawyers was sadly correct.

Lastly, I finally saw that outside of my own business echo chamber (both men and women business people), society holds pregnant women and new moms valuable above all else. Someone like me who is a bachelor & slave to capitalism has a totally different set of values, as such some people think I'm fair game for insults. But I hope by making products of value I can make a positive impact in my own way.

I met one of my college friends yesterday at a bar. She got married last year and was laying down the struggle of finding a new job. 

Now, apparently in many interviews when she reached the final few rounds, the HR or the Hiring Manager enquires about marital status and whether she has any children. 

When she mentions that she recently got married and that she does not have any kids, the company stops responding to her. 

She elaborated that although they might have found another fit for the role but she is a T-1 grad who did her Masters from an Ivy League college and has worked for 4-5 years in both NA+EMEA and India.

It is becoming more apparent to her that, HRs and Hiring Managers have a strong bias because they are definitely presuming that since she recently got married and will likely have a child soon, that she will use up her maternity privileges leading to significant productivity drop. Meaning, that the company will likely have to hire someone else to make up for productivity loss.

She does not plan to have kids for another 3-4 years but getting married is proving really hard for her. 
Especially in the Series B+ startups that she is applying to.

Hi. Does anyone know if taking a sabbatical during pregnancy can lead to the company using this as a reason of non-performance to either fire the women or not provide her with the maternity leave benefits?

Context
1. Company is aware that the person is pregnant
2. Person in question has been with the company for 2+ years
3. Past appraisal ratings have been 'Exceeds Expectations' or 'Meets Expectation'
4. Sabbatical period could be 1-2 months. Maternity leave will not immediately start after the sabbatical
