Need Help: Fraudulent Transaction on HDFC Credit Card & Unfair Liability

Hi everyone, I want to share my experience with HDFC Bank regarding a fraudulent transaction and seek advice or support from those who might have faced a similar issue.

On December 10, 2024, I was scammed into installing a malicious app that stole my HDFC credit card credentials and OTP. Using this stolen data, the fraudster made an unauthorized transaction of ₹1,47,000 to EaseMyTrip.

I immediately: ✔ Reported the fraud to HDFC Bank, who blocked my card and issued a new one. ✔ Contacted EaseMyTrip multiple times, but received no response. ✔ Reported in cyber crime online, the case is now forwarded to my city police station. But the contact number which they gave me is not reachable. I don't have any hope

However, despite raising a fraud complaint the same day, HDFC Bank held me liable, claiming the transaction was “authorized” since an OTP was used.

Issues with HDFC's Investigation:

1️⃣ They changed the reference number for my case without any explanation, raising concerns about how they handled the investigation. 2️⃣ I escalated multiple times, but they refused to acknowledge that I was a fraud victim and insisted I pay the full amount. 3️⃣ To avoid interest charges, I paid the ₹1,47,000, causing significant financial and emotional distress.

I filed a complaint with the RBI Banking Ombudsman, but HDFC repeated their stance, ignoring the fraud aspect and failing to clarify the reference number change. They also refused to compensate me for my loss.

What I Need Help With:

  1. Has anyone faced a similar issue with HDFC or any other bank?

  2. Any suggestions on how to challenge their decision further?

  3. Any legal or consumer rights advice on holding the bank accountable under RBI guidelines?

I’m so sorry this happened to you. I know exactly how it feels - the shock, the helplessness, and the frustration when the bank refuses to help. I also trusted the call because I had just gotten my credit card, and they knew all my details. It felt so real.

HDFC did the same to me. They ignored that I was scammed and forced me to pay the full amount (1 lakh 47 thousand 😭). I had no choice but to pay, just to avoid penalties and interest. Cybercrime was useless, and even RBI shut my case, saying ‘insufficient details’ when I had provided everything.

Since you haven’t paid yet, what’s your plan? Are you thinking of taking legal action?

By the way, have you tried calling the scammer’s number back? Did they ever pick up? Also, was the number they called you from 8808460170, or was it a different one?

Get a GOOD Lawyer. Complain to RBI Ombudsman or Consumeer forum. Your have a justified case. Retain all communications and evidence. Do your research on precedents and try to find cases similar to yours. Find a lawyer who has direct experience with such cases. Has been a personal experience that most lawyers are utterly incompetent.

I already filed a complaint with the RBI Ombudsman, and after taking that case number, HDFC Bank emailed me again with the same response. But surprisingly, RBI Ombudsman later rejected my case, citing 'insufficient' details. I had provided all the necessary information, so I’m not sure what went wrong. Maybe I need to file the case again.

Do you know of any similar cases where legal action actually worked? Also, any tips on finding a lawyer with real experience in banking fraud cases?

Sure, here’s what happened: I got a call from someone (Phone Number: +91 8808460170) claiming to be from the HDFC Credit Card Verification Team. They said I needed to disable a 'credit card protection plan' feature, or I would be charged a significant yearly amount. Since I had recently applied for the card and was expecting a verification call, this seemed legitimate.

The caller introduced herself as Priya (or a similar name) and even provided an ID number to sound authentic. She directed me to visit a website (axcpp.com) to disable the plan, which then installed an app named 'HDFC Helpdesk.' Trusting it to be genuine, I logged into the app.

Within minutes, I received an SMS about a ₹1,47,000 transaction to EaseMyTrip. That’s when I realized it was a scam.

Cybercrime complaints are of no use.

Yes, I raised a dispute with HDFC immediately, but they refused and held me liable, saying the transaction was 'authorized' because the OTP was entered. I explained that my credentials were stolen and that I didn’t make this payment intentionally, but they didn’t bother. I escalated this case all the way to the Principal Nodal Officer, but they still gave me the same response🙁.

Did your chargeback request succeed even after an initial rejection?

Interesting. I think Bank won’t help you in this, only Police can help and looking at how Police is, you know how it is. That said, I hope you did spend some time reading the fineprint of credit card’s t&c about such cases.

I did check the credit card T&Cs, but banks usually interpret them in their favor. RBI guidelines mention limited liability for fraud victims without negligence, but HDFC refused to acknowledge that. As for the police, I actually didn’t contact my city police because the mobile number they provided was not reachable.
