Are layoffs illegal?
I see my organisation is being very cautious about the layoff process. They are forcing us to resign instead of them firing us. Also the communication is put out saying we are resigning and serving notice period instead of mentioning severance.
Between overlapping state and central laws, it’s a grey area. Companies want to avoid any legal repercussions, especially startups because they have to disclose lawsuits to prospective investors. Therefore making people voluntarily resign is the safest route for them.
