Looks like yes. Google gives such a misleading result on this, telling that upto 25 lakhs is exempt from taxation. But I recently got some amount for leave encashment and only a part of it is shown exempt in taxation sheet provided by the organisation. It appears that just like HRA exemption calculation, for leave encashment too the Govt has some shitty calculation rule

I work in EY GDS. My last working day in October. I have 28 Annual leaves.
I know that personal and special leaves can't be encashed.
Can I encash all the 28 Annual leaves? Or is it only 15leaves?

Also not been sick whatsoever, even during covid. I don't know why.

My job requires travel so I do get to spend time abroad.

The last cycle, I ended up making an extra 20L from all the leave encashment paying out at once. That's now worth 24L from a small cap MF.

Why does anyone bother with leaves if you are planning to retire before 40? I want to quit working while I'm still healthy.

When you resign from your job, and have like for example 15 paid leaves that you haven't utilized, is the company obligated to encash those leave or use those leaves to release an employee early?

Was talking to a friend of mine who got laid off early this year in January. While the org gave him 3 months salary additional to the leave encashment payment. 

He mentioned most of the amount was deducted in TDS as what was left for him was not even two months salary.


Imagine someone who got laid off and is in dire need of money, He gets some severance from the organization and government eats majority of that as well? Absolute shitshow. 

IMO there should be some clauses to exempt this income from tax liability atleast in the same FY. You can ask him pay additional taxes when he gets the job but not on severance package.

I got salary of 250000 in April which includes bonus + leave encashment around 90k, for which there was a 50k income tax cut for this month. HR said since bonus was more, they had to deduct 50k. Is this how it is usually done? Is that amount justified?

I'm a fresher working at a startup.
I have too many sick leaves but don't have paid time off.
Some people at the company said that you can't encash sick leaves. I feel cheated. I mean I could have used these sick leaves instead of paid time off ones 🥲

In my company we have 1 leave per month. Basically after working all January a leave will be credited in February just like our salary and we get 12 leaves per month only (PTOs).
What is your leave structure.

Pros and Cons of Unlimited Leave Policy

I have some ESOPs($17k total) at my current company(startup, initial stage), vesting over 4 years with a one-year cliff (25% vested after my first year, monthly after). I have completed 1.5 years here.

I'm not sure if they're actually worth anything(no funding rounds since last 2-3 years, founder is saying he will raise in next 3-4 months), and I'm worried about the taxes when I eventually redeem them. Also I dont know about the redemption process. Could someone explain how this whole ESOP thing work, what the tax implications are, and where I can find more information?

what all should I ask to my manager/HR as we dont have any portal/guide where I can see all these information.

how to track how much is vested?
how do I redeem them?
can I not redeem them this year, will they still be available to me in next financial year?

ESOPs are confusing

I got to know that i paid extra tax as I made mistake while filing my investments / leave encashment 2 yrs back. Is there a provision to recover / claim for extra tax paid before? Kindly help me 🙂
