Harassment by police patrol

I was standing near Whitefield in my 4 wheeler around midnight, just away from the hustle bustle of the fast life, smoking a cigarette and had a beer 1 hour before the incident (beer can was present in the car) when a police Jeep stopped and asked me to come out.

They checked my entire car (to find more illegal drugs 'read Marijuana') but didn't find anything.

Started threatening me with the car seizure. When I asked them to do breath analyzer test as I was 100% sure of being in the permissible limit, they asked me to come to police station for the same after they issue me a challan.

How can they issue a drink driving challan when I am not drunk and without a breath analyzer? And started threatening me with 25000 rs fine plus car being released in 6 months plus more than a lac of rupees in lawyer cost. (Ofcourse bullshitting me)

They were doing the proper good cop bad cop tactic and I had to pay them 7k bribe just to get out of there. (Couldn't risk the whole court drama, couldn't afford time as I was roaming without the knowledge of my family and avoid anxiety to them and my car also has northern registration)

But is this justified ? Can we not even smoke a cigarette in our vehicle in this godforsaken city ? Do we need to be mindful of the goons or the police ?

Anyways, what is the best way to get out of such situations?

It is not illegal but becomes illegal when u r drunk and tested positive... It is ok to stay out at midnight...unknowingly if there is a dead body some feet away from u and u didn't get a chance to notice ...the first thing police do when they enter crime scene is suspect you and include u in the FIR report....

Haan that can shouldn't have been there.
But they did not do any test.

If you live with family, sometimes it's not possible to drink at home in the middle of the week.

Parking the car around midnight in a public place and smoking with a beer can lying inside is like serving the police everything they want on a platter! Knowing that police if they spot you can harass the heck out of you and yet going ahead doing this is like bringing it upon yourself.

Blaming the system is one thing. How qualified are we to blame the system is another! You could've saved yourself all the hassle had that smoke waited for a private place.

It would have been okay if they had done breath analyzing.
The permissible limit is 30 mg of alcohol in 100g of blood which roughly means 2 pints of beer is fine.
I had taken that beer 1 hour before, so there is no chance of being out of limit.

But the point is THEY DIDNT DO THE TEST.

While I agree that I invited all the troubles, but what was wrong here ?
I wasn't drunk.
I had a very very stressful last few weeks both at family and work front and just wanted to go somewhere and think about everything in peace over a cigarette!

While I agree the breathalyzer should have been used, smoking in a public place was more than enough an excuse for them to hound you (the fine is 200 or something but trust our police to not settle for that). The best we can do is avoid things that draw unnecessary police harassment.

Bangalore cops are more corrupt than the north. For everything they want is hard cash, one of my friends was smoking a joint in his home, police forcefully barged in and arrested him for smoking one joint. They asked 50k to let go, but he didn't give, so they put him in jail for 2 nights and put a report of possession of 2KG of marijuana. Finally released after parents came with 25k bribe. He is from Karnataka staying in BLR.

Just that one is earning insane amount of money does give one license to do whatever they want in public ..think what could have happened if they had kept you in jail for 24 hrs or prosecuted you it could could have been a large damage to you and your reputation atleast they penalized you so that you will learn a lesson in future ..if you were right you had never bribed them...the only way one can expect fairness when you are fully right thats what I learnt years back.

I always thought software engineers were really good at working at edge cases.
I gave them money because my family was waiting at home, couldn't afford to get in the mess of courts etc and not because I was in the wrong here.
