Broke Employment Bond: Legal Notice from Previous Employer
Back in 2021, I joined a small company as a fresher with a promised CTC of 3.2 LPA and a 3-year bond. However, after joining, I discovered the actual base pay was only 1.8 LPA, and my monthly salary was just 10,500₹. So, after five months, I broke the bond and joined Accenture. Now, almost three years later, the previous company's advocates are sending me notices demanding 3 lakh rupees as bond repayment, and I even received a notice from the civil court yesterday. I'm not sure what to do next. Do you think this will affect my future job prospects? I have records of that company in my PF account, but I don't consider it as part of my work experience. Do you think future employers will ask for documentation for all companies listed in my PF records?

Looks like they sold it to debt collections who are faking the court notice (most likely). Most court records are digitized these days so you can check online. But there 99% chance that it's fake. I got a similar thing for non payment of internet bill when they sold it to collections. Turned out to be totally fake. Court notices aren't served on email.

Court notices can be served via email. Don't assume it to be fake just because it is sent via email. BSNL serves notices via email and those are completely legit.

As far as I know bonds are not legally enforceable in India
They are if company can prove they have spent some amount of money on you training, foreign trip etc .

Call the HR of old company,
Say your notice and bond is invalid and stop bothering you. Else you will file a case against them for mentally torture and not giving EPF. Bond is not enforceable to you so chill.
Talk first, get a lawyer send a notice if required and you won’t face any issue.

Yeah try out the same. Forcefully bonds and asking amount is not valid either way even for your training if you haven’t took any paid courses then they have nothing to show as well. Just be bit aggressive on the call and say what I told you. That will end your case.
Apart from that if you are getting any calls or threats record them or if they visit you beat the shit out of them.

What did the notice from the court say? Are you sure the letter is actually from a court?
This is the Mail I got with notice. And the That notice have stamp of Civil court.
“Our Client P******* Technologies Limited has filed Regular Darkhast No. 83/2024 against you in Hon'ble Belapur Court for execution of an arbitration award dated 14/08/2023. Attached herewith is a copy of the summons notice as issued by the Hon'ble Court in the said matter. Service is hereby made on you by way of email.
You may please attend the hearing if you so desire.”
Bro just take help of a lawyer. Or can ask help on LinkedIn there are some community group of lawyers

Go to a lawyer directly, whatever the case is it is better to let the expert handle it, also always keep documents from prev employers as it will help in such cases.
Please do update on what happens later.

According to laws, these kind of cases mostly goes in employees favor.
Companies can only ask for a reasonable bond amount if they've provided you some training during your onboarding - that's what the law says
but If case stand in the court this might take time for court result. This will affect my Career ,time and Money also

They didn't gave me my last 3 months of salary during my notice period.
My new employer understood my problem that why i don't have any experience letter.
My friend is also having a similar issue.. right now he is worried about his career.

If you don't mind sharing, what's the email-id it was sent from?
If you have the time and resources to spare, hire a lawyer and you can send the company a notice back citing contempt of court due to falsification of a court order.

who told you they can't send it on email? what legal knowledge do you have to counter this ?

Legal notices are a separate matter and don't carry the same weight.

this is why I tell people not to take these things lightly, so many people just keep flying in the air without understanding consequences of their actions
At that time that company took the advantage of of our situation. and that much Low salary for 3 years till date. I definitely cannot live in Mumbai
I resigned from TCS within 1 year and got notice after around 3 years i got a notice from India Law on behalf of TCS for breaching service bond agreement this India Law is third party not court

You should ask any expert about genuinity of mail and if it is genuine you should prove that they didn't gave you any training

First and foremost check the validity of the letter. Only respond if you can positively say it's real
Bonds are not legal in India and every person has right to earn in India .don't give them anything they can't do jack shit in court
Ap per my knowledge bonds are illegal and they can only claim the amount of money which they have spent on your training. Any idea how much they were spending on your training? I am not a lawyer though. Just know few things as i had to sign bond during my initial career.

See nothing will happen, you just have to pay the amount, only if they provide relevant proofs of the amount spent on training etc. Only an expert lawyer can help you deal with the above. Also, they have created your UAN, so take all the necessary documents from them(including release, experience etc). As your next company will surely do a verification via pf. Nowadays companies do a pre joining verification before providing the offer letter. Also, verification is done on the EPFO account to check your employment history, pre or post employment. And next time don't hide the last company history as it can be tracked down.
Court will say why it took you three years to send notice and I have not seen case of bond in court only issue is regarding start and end date in epfo portal
