Let’s say I leave a company after 2 months. What would happen if I don’t return their joining bonus.
They have a clause in offer letter that says I should return the amount if I leave before a year.
Return doesn’t mean you will go hand it over to them. It means they will deduct that from your FFS or salary. Which ever is applicable
What you are doing is stealing money. They gave you money on pretext that you will stay. You signed the contract. Now you breached the contract and not returning money. It is a legal act. They can send you a court legal notice to return the amount in let's say 1 month. if you do not comply, an warrant will be issued against you. Even if you do not reply to legal notice, the case will move towards employer's favour.
Some BCG check companies like firstadvantage and all also check about active cases against you if there are any. do not get into some trouble when it is not worth.
Thanks for the insight. Would they really go to court after a 5 lacs joining bonus? I’ve read up online on Blind about some people who didn’t payback joining bonus but I’m not sure if it’d work in India.
This company don’t have any legal, HR team in India just small engineering team. However, they are a billion dollar company in US.
@Mrwick Just what i know is that whenever a company wants to operate in an unknown region, they reach out to a law firm who manages to get the licenses for them to operate and register the company. so in no way that there won't be a legal team.
However, in such case you can take a risk to not return money till they do not send you legal notice. If you receive legal notice then make sure you keep record of money returned and get an NOC from the company for future safety.

Nothing much, they just won't issue your experience and clearance letters. Good luck joining somewhere else with those.
