Company Forcing Me To Serve 90 Days Of Notice Period.

I work in an IT service company in Pune, Maharashtra which I joined on 1st Nov 2021. In my offer letter notice period is mentioned as 60 days. 1 month after joining the company, management decided to change the notice period to 90 days as a company policy for each employee.
But during that, they asked for our consent which I did not give. I have it in an email as well from an HR help desk that I'll have to serve 60 days of the notice period.
But still, when I want to resign they're asking me to serve 90 days of the notice period.
I talked to HR about this and they said each employee was contacted personally by HR and was given an option either agree to the policy change or resign within a week. Now the problem is there is written communication about this in my inbox from my HR or even an informal message on a company messaging application.
I want to know if it's legal and if can they force me to do it even if my offer letter says 60 days of the notice period.

But imo, unilaterally contracts can’t be changed and this is unenforceable unless your consent was there.
Perhaps, ask the HR for proof of agreement from your side. If they don’t provide it then it is time to either ghost this shitty company or mention legal discourse.

@IndifferentGoku you have several different courses of action depending on what outcome you're looking for Legally, you're right, you can choose to stop working right this moment, but there may be "soft" consequences to that, such as the company delaying or neglecting your FNF, spreading bad word about you in the industry, etc

Not surprised. Legal system in india is broken. We have to live with such adhoc changes. What can we do as employees?.. do a shitty KT. I was also aksed to serve full 90 dyas notice. I did nothing during the notice period. I came to office sat of 9 hrs and went back home. My KT was so poor that my replacement guy quit in the following 3 months as he couldnt handle stress. In the name of KT i would mark the whole team on all emails etc.. they asked me if i want to be relived after 87th day which was a friday. I agreed. And the cut 3 days pay for not serving the full notice period. ( sat,sun and mon). As 3mplpyees we are fighting pigs.. it will stink and we will be covered in shit. Untill we land on our feet we got to deal them. My contempt towards them was so obvious that my friends would joke saying "if there was a fire, i would simply pick my car keys and walk away rather than try to alert the admin". I worked in that company for 13 months.
I am also about to resign and the I will have to give KT of 8 to 9 products to a tech lead. It literally took me months to get the understanding of the products as there was no senior at the time I was onboarded. The coming 2 months would be the worst 2 months of my life 🥲
My advice dont give proper KT. Hide critical issues. Just give enough so that the replacement doesnt suspect anything amiss. He wil suffer. But so will half of the hierarchy. Its a pin prick but it will be to their heart.
The written record will prevail if you choose to proceed legally. However, the HR being HR can fool around with your release letter and F&F. If do choose to move out in 60 days, please ensure that you maintain your conversation on record and keep pestering them every week for your FNF amount and release letter. Cheers.
They cannot do anything if you don't serve it they may keep your salary if they freeze you accounts in notice period
