Basically the title. Did one of these about a year ago and thought I'd do another one. A bit about me - I'm a lawyer, I specialise in startups, international law (especially concerning Web 3) but have worked in a boutique role (basically, 0-100 everything legal). How do you write very long sentences that have multiple clauses, accommodating commas, referring to pronouns and adverbs like hereafter, thereafter, which never really seem to end but as soon as they do, you put in a semi-colon; and start afresh?

@Rhombus The capsicum seedlings seem to be coming along nicely. I split the monstera into two and the OG one is doing well but the separated one is suffering from separation anxiety (and I'm regretting my decision) so hoping it survives.
Two of my aglaonema are throwing unnecessary fits and I can't, for the life of me, figure out why they're acting this way! The lime pothos are also being drama queens and a few cuttings have died on me... I had quite a few so I'm hoping at least some survive and pull through... I'm actively hunting for new cuttings, the next free evening I get I'm going to go to my local park and steal some cactus cuttings.

How much time does to take to get final judgement in case fraud case filed against builder?
Honestly, this really depends on how much time and effort you're willing to put in and the court your case is in.
The South Delhi Consumer Commission is known for resolving cases super quickly and are strict with adjournments, but cases still drag on for years.
One of my family members is a part of a case against a builder in the NCDRC and the case took 8 years and still did not yield a particularly favourable judgement, however, another case in the same bench received a favourable verdict in 2 years.
So it really depends on how active you are and how active your counsel is. If they're attending courts, they've got all their papers in order and are demanding early hearings. The Court has thousands of cases, they're not going to give you special treatment till to force them to do it.

I own an apartment but rented it to a tenant. If my tenant commits something serious (like suicide) and I had no involvement in it, what kind of troubles would I be looking at?
@GrimBeard75 You won't really be in trouble directly, but your property might be cordoned off as a crime scene and you might have to wait a while or jump through hoops to get it cleared for use.
Unless, of course, someone alleges you had something to do with the suicide or the crime that is committed.
Make sure all you get police verification done for all your tenants. If a tenant commits a crime and turns out you didn't get police verification done, you'll be in trouble (not giant trouble but trouble nevertheless)

I always wanted to know few basics about laws that everyone should be aware about, is there any directry we should follow to know the terms?
Such as, employee protection laws, road safety laws, in general if officials are scamming us out, can we get back at them by throwing some insights about the actual laws so that they can back off?

A general rule I like to say is, if you think it makes sense to have a rule for or against something, there probably is one.
Unfortunately, in India, there are no employment laws for white-collar workers. We have a new labour code that has been approved by the Parliament, but it hasn't been notified yet (and no one knows when or if it might be). You have to rely on existing case precedence or principles of law.
In India (and in common law), the party with less power in a contract or negotiation, is always favoured. So the employee (the lower the rank, the better) is given the benefit against the company, the consumer against the company, and the insurance taker against the insurance company.
For road safety, I advice never to hand over your licence or papers to the cops, always SHOW them on Digilocker and refuse to hand over your phone. If you're ever being accosted by the Police or feel like you're being extorted, DO NOT show off how well you know the law. ALWAYS be polite and ask them what is the issue and that you wish to call a senior/elder person. In India refusing to reveal your name and cooperating with the police is a cognizable offence (police can arrest without warrant). Unfortunately, do to practical reasons, it is easy for the police to make your life difficult if they wish to. Always be super polite and ask them their names and police stations. Try to ensure all dealings happen in a public place. Refuse to understand any "indications" or "indirect" gestures, always ask them to spell out what they want.
Ooh, I found the material they give to learner drivers to be very helpful in terms of traffic rules and violations. Also, there is a concept of absolute responsibility in law - ie, whoever has the more dangerous/onerous object, they have a higher duty of care. So if you're in a car and you hit a pedestrian, even if the pedestrian was a little at fault, the prima facie responsibility is yours because you are in control of the more dangerous machine.

I was asking about driving rules because many folks literally just dont follow any rules at all, esp autos and two wheelers guys. And when I stop at red signal, obv I’m being called out by many strangos’ about how I could have dodged that signal and let them pass too.
In metro aswell (basically common sense) they won’t follow the rules. I guess there should be a penalty for people who are breaking the queue, and trying to board the metro before letting others to drop off. Everyone is busy, but shoving others, filling people inside metro like vegetables is not okay.
Thank you for the heads up about not to SHOW OFF to the police. A digitlocker part and public place. But can we also video record the interaction, just to be safe?

Why can't India have stricter laws in terms of employee protection? Mostly in terms of layoffs. If the answer is that we have a bigger population and it does not make sense to have strict laws as we need more job creating companies, but do you know of anything or any future bill possibility that could improve something in this area? Things like severance and all
@necro Very good question. It has absolutely nothing to do with the population. In fact, the Parliament has passed a new wage code but it hasn't been notified. It's not the best thing in the world, but it definitely A step. It does make it mandatory for a company to clear an employee's FnF within 2 days of termination.
Internationally, there are employment laws where if the FnF is not cleared within 14 days or so, an additional penalty is applied on the employer. I think that can be a good provision.
The reason why we don't have it is the same reason why we don't have an AI law, the same reason why we're still waiting for proper Mental Health Rules under the Bill, it isn't a priority for the government and no one is working on it.

sir not related but can you share the range of your compensation? Also, did you get BA LLB integrated or LLB after graduation?
@Grub96 I did BA LLB. I graduated in 2022. I work with an international law firm and I take on a few private clients as well. On an average, I take home about $4000 a month, give or take a bit.
My compensation is on the higher side for my level of experience but that is because I worked super super hard to develop the skills I did and I work a super high risk job. Its very stressful and very volatile.

@JadeArgent Oh that's awesome. I've heard many discourage from doing LLB after graduation because outcomes of BALLB and LLB are vastly different. People don't really get the corporate jobs after LLB. But how is the outcome of say someone who does an LLB after BTech and they want to go independent?

@Piderman Hi, so sorry I am late to this but super great question!
Look, family law cases are highly subjective. It really really depends on the particular facts and circumstances of the case. What you see in news and media being popularised about women living comfortably off of alimony is the same as watching college dropouts become Steve Jobs. It's a one-in-a-million thing and for every one person who gets/does that, there are several thousands suffering.
The truth is, even with alimony or maintenance payments, the woman usually gets a very small amount. Do you think Rs. 15,000 is enough to survive on in a month? Even now there is a bias against women, not just in matrimony but in sexual cases too.
I'll give you an example - One of my distant relatives got 1 crore + as a "settlement" after a divorce that she initiated within about a year of being married. Her husband doesn't really have a job, they have a family business. She comes from the same economic background, so she didn't really need maintenance money. Sounds shocking and headline-worthy, doesn't it?
Here's the behind-the-scenes - the husband was an egoistic maniac and his family used to bully the girl. He beat up the girl once and she came home crying. She'd been married less than a year. She refused to go back to him and insisted on divorce. She and her family had spent more than Rs. 1 crore on the wedding, including all the gifts they gave to the groom's family. They simply demanded all of that back. Does that still sound shocking?
Another acquaintance has her life stuck in limbo because her husband refuses to attend divorce proceedings. She initiated a divorce back in 2016 after she got married and realised she'd been lied to about the guy's job and house. When she asked him to explain himself, he hit her and she walked out. She has a male lawyer who refuses to use "under-handed" tactics such as filing criminal complaints against the husband and his family in order to force them to attend the hearings. Since there's nothing forcing him, he simply skimps out on court. He still has all her wedding jewellery.
What I'm trying to say is that, yes, laws can be misused, but the idea of women taking advantage in marriages and of certain laws is blown way out of proportion than the ground reality. You should be less scared of a woman filing a false case against you and running away with your money than you should be of an acquaintance or friend filing a case of fraud or cheating against you.
@JadeArgent That being said, here are a few tips on ensuring your property is protected:
1. Avoid cash transactions and make sure all your wedding expenses and gifts have proper bills or receipts so you can separate your expenses from your partners'.
2. Similarly, try not mixing up jewellery. Don't give your gifts or jewellery to your in-laws or wife without making sure the expenses and values have been recorded.
3. Prenups are not valid in India, but it would be good to have some form of an understanding on possible asset division during the marriage. It could signify intent.
4. Keep finances separate. The more the finances are merged, the more likely it is that one partner is likely to get an unfair settlement.
But is this all practical or is this all so cynical, it would likely dent your relationship anyway? Just like you can't keep yourself walled up forever and have to risk heartbreak, you have to risk an unfair settlement :3
