My brother got this mail from his HR

My brother got this message from his HR. He had signed a 2 yr bond as fresher after bachelor's and he quit after a year. Can they do any harm in terms of career?

  1. If your brother took a signing bonus with 2 year bond then he has to return it.

  2. If there was no signing bonus involved the HR can only threaten, there is nothing they can do.. court will kick them out

He need not return the signing bonus either, depends on the terms of the contract

I agree with @JadArgente but dont take risk.

Usually the contracts protect the company and they are intentionally vague.

If you return the signing bonus back to company, there will be a record of financial transaction that fulfills your obligation of not obstructing recovery.

After this companies will not threaten, they don’t have any incentives and you have a solid proof of good faith cooperation in recovery. No lawyer will want to take up such case.

Always play safe in corporate matters and don’t be a rebel.

Name and shame. Which company is this?

@JadeArgent knows a bit about the enforceability of these bonds.

Strict legal advice - as @UrbanRun44 mentioned, they can only recover the expenses spent in training him

Lol no. Bonds are not enforceable in India. This is an empty threat.

Im not telling that they will enforce him to pay, whenever a new employee joins an org they will do BCG, and if something like this comes up they may not end up hiring him

Just say no. Bonds are not enforceable in India. They lose 100% of the time they go to court, and it's not worth any time/money.

Involve a lawyer and send them a fancy reply, similar to how they've written

Better to get a lawyer involved. HR shit in their pants when lawyers are involve

Did they spend time/money on training him? If yes, then they may have a case. Better to discuss it with a lawyer.

NAL but certain there's no case even if tangible time/money was invested, unless there was a time-attached bonus
